A CAMBRIDGESHIRE motorist has walked free from court after he was cleared of causing the death of a Lincolnshire motorcyclist.Ian Duncan MacIntyre, 58, was driving his Jaguar XF sports car when he collided with a Ducati motorbike ridden by David Blackburn on the A155 at Hagnaby.Mr Blackburn, 53, from West Keal, died as a result of the crash which occured shortly after 5.30pm on April 9 last year.
The prosecution alleged Mr MacIntyre was driving carelessly when he pulled out of a staggered junction into the path of Mr Blackburn’s motorcycle.
But a jury at Lincoln Crown Court cleared Mr MacIntyre of causing Mr Blackburn’s death by careless driving after hearing he simply did not see the motorbike coming because of the sun which he described as “low and blinding.”
Mr MacIntyre was discharged from the dock after the jury took just minutes to return its not guilty verdict at the end of a three-day trial.' - Taken from Horncastle News.
On the information that has been reported regarding this case, this could be seen as a miscarriage of justice towards the motorcyclist, David Blackburn. We are currently investigating this further to see how and why the jury came to their 'not guilty' verdict.

Reading this makes me so angry, if it had happened in north wales he would have been charged for sure but my condolence goes to Mr Blackburn's family

But we have a National Justice System "allegedly"
I hope the MAG solicitor gets some answers
For the sake of Mrs Blackburn and her family
And for the rest of us, or we all become "fair game"
For the MacIntyre's of this world
Significantly we are not given the "defendants" occupation
But I bet he wasn't a bricklayer on his way home from work

It would seem the jury accepted his argument of "I couldn't see if it was safe so I pulled out anyway" Sad pointless loss of a life.

We understand that the item of news we reported about the death of motorcyclist David Blackburn has angered many of you and us included.MAG has been working on establishing all of the facts pertinent to this case. As part of this process we have been in touch with Lincolnshire Police. The Head of Casualty Reduction of Lincolnshire Road Safety Partnership, Detective Inspector Rob Grace, has been kind enough to come back to us with the following statement:
"We are disappointed at the outcome of the case involving the sad and avoidable death of David Blackburn.
The Lincolnshire Police Collision Investigation Team conducted a thorough investigation into the circumstances, and presented the evidence to the Crown Court where a Jury returned a not guilty verdict".
We are continuing to gather further information in order to formulate a course of action in this case.
We will continue to update you as and when we are able to do so,

How many bikers on the jury I wonder or friends and family of bikers. As for the police they do not have our interests at heart. I was hit by a Taxi , breathalyzed even though I had chest and shoulder injuries and went off in an ambulance and my machine sent for disposal by west midland police due to being abandoned in the road. Insurance under writer fast action stopped disposal of bike.
